At ClimateSeed, we are committed to helping businesses around the world contribute to positive impact projects as well as measure GHG emissions and propose associated reduction strategies. Our ambition begins with protecting the privacy of everyone in our community. This means that we'll protect the personal information of all visitors who contact us by email or any other means, who access our website (https://climateseed.com) or services through any mobile application, platform or device (hereinafter referred to as the "Service"). 

This privacy policy ("Privacy Policy") explains how ClimateSeed, our subsidiaries and affiliates collect, share, and use personal information notably when using the Service. You will also find information about how you can exercise your privacy rights. By using our Service, you agree to ClimateSeed using your personal information as described in this Privacy Policy. The terms "we", "us" or "our" are each intended as a reference to ClimateSeed SAS, the company offering and operating the Service. It also aims at informing you on the modalities of data processing in accordance with the Regulation (EU) 2016/679 (General Data Protection Regulation) (“GDPR”).

1. Who is data controller?

The data controller is ClimateSeed as defined hereinabove for the following processes: 

  • Processing of your personal data performed on the website 
  • Processing linked to the monitoring of clients relationships 
  • Processing linked to the monitoring of prospection actions 

However, when ClimateSeed clients use the Service and subscribe to our offers, it is possible for certain offers that ClimateSeed collects and processes personal data of users on behalf of our clients. In that case, ClimateSeed clients are data controllers in accordance with article 4 of the GDPR. 

2. How we collect and use (process) your personal information

2.1 Type of information collected and processed 

ClimateSeed collects personal information about its website visitors and clients. 

2.1.1 Information provided voluntaril

  1. a) Contact information

When you contact ClimateSeed by email, using electronic form offered by our Service or by any other electronic or non-electronic way, ClimateSeed collects information about you which include:

  • name 
  • job title 
  • name of the organization you represent
  • work email 
  • additional details provided in your message as you may deem fit
  1. b) Use of the carbon footprint emissions and reduction platform as well as CSRD reporting features, and of the climate contribution platform

When you decide to create a ClimateSeed account for the organization you represent, ClimateSeed will collect information about:

  • name 
  • job title 
  • name of the organization you represent
  • work email 
  • name, position, level of rights and email addresses of other users of the platform (including authorized signatories of your organization for signing contracts with ClimateSeed).

In addition, for project developers, we may collect additional information such as:

  • name and ID of the legal representatives or board of directors
  • name and percentage of ownership of the ultimate beneficial owners
  • marketing materials that may including the name and photos of individuals
  1. c) Information regarding your marketing preferences

ClimateSeed collects information about your preferences to receive marketing information any time you subscribe or unsubscribe. You have the possibility to unsubscribe at any time.

  1. d) Feedback

When you post messages and reviews of the Service or you contact ClimateSeed, ClimateSeed collects information about you including your name and the content of your query. 

If you contact ClimateSeed’s clients’ support teams, we will record and keep a written record of the request for the resolution of your queries. 

2.1.2 Information collected automatically 
 

When you access ClimateSeed Service, ClimateSeed may collect certain information automatically from your device. 

In some countries, including countries in Europe, this information may be considered personal information under applicable data protection laws. 

For instance:

Activity information (navigation data): we collect information about your usage of the Service and information about you from the content you create and the notifications or messages you post or send as well as what you search for, look at and engage with (log files, operation system and other usage information about the use of ClimateSeed’s website, including a history of the pages you view)

Cookies and similar technologies: we use cookies and similar tracking technology to collect and use personal information about you (e.g. your Internet Protocol (IP) address, your device ID, your browser type and when, how often and how long you interact with the Service), including to facilitate interest-based advertising (identifying visitor preferences)

For further information, ClimateSeed makes available a comprehensive “Cookies Policy” (https://climateseed.com/cookies-policy) that describes the type of cookies and similar technologies used and controlled by ClimateSeed websites and provides information on how users can accept or reject them. 

2.1.3 Information obtained from third party sources 

From time to time, ClimateSeed receives personal information about individuals from third parties. Typically, information collected from third parties will include further details on your employer or industry. We may also collect your personal data from a third-party website (e.g. LinkedIn). For instance: Analytics reports and market research surveys: We collect information from our third-party affiliates about the way you respond to and engage with our marketing campaigns so that we can customise our marketing and Service accordingly. We may also receive aggregated information in the form of audience segments from third party sources to display targeted advertising on digital properties operated by organizations like LinkedIn and Google. If you choose to share information from the ClimateSeed website through these services, you should review the privacy policy of that service. If you are a member of a third-party service, the aforementioned connections may allow that service to connect your visit to our site to your personal data.

We do not sell personal information to anyone and only share it with third parties who are facilitating the delivery of our Service as per article 3 below.

3. Who ClimateSeed is sharing information with? 

In delivering the Service to you, we may share your personal information with the following entities:

3.1 Third parties’ providers

  • We may share personal data with third parties who undertake various activities to promote and support our Service. This includes website and application support and hosting providers, marketing service providers, eCRM partners, billing and accounting providers, market research companies and payment processing providers which process payment transactions - any of these third parties might be inside or outside your country of residence. 
  • We may also share information with third parties so that they can contact you about goods or services which may interest you. We will only share your information with these third parties where you have given your consent. If you don't want us to use your personal information in this way or generally change your mind about receiving any form of marketing communications, you can unsubscribe at any time using the unsubscribe functionality in the communication you receive or by amending your profile accordingly.
  • If you choose to unsubscribe from our marketing, we will keep a record of your preferences so that we don't bother you with unwanted marketing in future. 

If any part of our business enters into a joint venture, purchases another business or is sold to or merged with another business entity, your information may be disclosed or transferred to the target company, or new business partners or owners or their agents and advisors. In these circumstances we will always inform the relevant entities that they must only use your personal information for the purposes disclosed in this Privacy Policy.

3.2 Legal authorities

Your personal data can be transmitted to any law enforcement or regulatory body, government agency, court or other third party where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person.

3.3 Any other person provided that you have given your consent to the disclosure

We will not sell, distribute or lease your personal information unless we have your permission or are required by law to do so.

3.4 Sub-processors

Third parties listed as defined in article 3.1 can be considered as sub-processors.

4. Is there any international data transfer?

The personal information ClimateSeed collects from you is stored in one or more databases hosted by third parties whose servers are located in the European Union. No data will be transferred by ClimateSeed outside the European Union.

5. How is your personal data secured? 

We place great importance on keeping your personal information safe and secure. As such, we put in place appropriate technical and organizational measures / industry standard technology to protect it from unauthorized access and unlawful processing, accidental loss, destruction and damage. The security measures we use are designed to provide a level of protection appropriate to the risk of processing your personal information. Where you have chosen a password which allows you to access certain parts of the Service, you are responsible for keeping this password confidential. We advise you not to share your password with anyone and to use a unique password for our Service. We will not be liable for any unauthorized transactions entered into using your name and password.

6. Children's data

We do not knowingly attempt to solicit or receive information from children.

7. What are your rights over your personal data? 

The GDPR and other countries’ privacy laws provide certain rights for data subjects. Data Subject rights under GDPR include the following:

  • Right to be informed: this is the purpose of the Privacy Policy in accordance with article 13 and 14 of the GDPR.

  • Right of access: ClimateSeed provides you with the tools to access your personal information at any time through your account in accordance with article 15 of the GDPR.

  • Right to rectification: ClimateSeed provides you with the tools to review or update your personal information at any time through your account in accordance with article 16 of the GDPR.

  • Right to erasure: if we collect and process your personal information on the basis of your consent, then you can withdraw your consent at any time in accordance with article 17 of the GDPR. 

Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

  • Right to restrict processing: you have the rights to obtain the processing limitation of your personal data in certain cases defined in article 18 of the GDPR.

  • Right to data portability:  in accordance with article 20 of the GDPR, you can request to receive personal data transmitted to ClimateSeed in a machine-readable format and request their transfer to the recipient of your choice. 

  • Right to object: in accordance with article 21 of the GDPR, you can object to the processing of your personal information. Again, you can exercise these rights by contacting us using the contact details provided under the “How to contact us” heading below. 

  • Right to complain: You have the right to complain to a data protection supervisory authority about our collection and use of your personal information.

  • Right to define directives related to conservation, erasure and communication of your personal data after death.

8. Updates on this Privacy Policy  

We may update this Privacy Policy from time to time in response to changing legal, technical or business developments. When we update our Privacy Policy, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any material Privacy Policy changes if and where this is required by applicable data protection laws.
